BEG - Health treatment

In accordance with §§ 28, 29 No. 1 of the Federal German Restitution Law [BEG] a persecuted person who has suffered either considerable physical injury or damage to his health has a claim for health treatment.

The extent and fulfilment of this claim shall be in accordance with § 30, Section 1 Federal German Restitution Law [BEG] in compliance with the legislative Civil Ser-vant Accident Welfare Regulations, today regulated under §§ 33, 34 of the Civil Ser-vant Welfare Act in connection with the hereto enacted Heilverfahrensverordnung laid down under § 33, Section 5.

The claim is given for specific physical injuring or damage to health which has been recognised by the compensation authorities as being due to persecution.

The recognition of health treatment follows as a result of the first decisions made by the compensation authorities in respect of the compensation claims filed for physical injury or damage to health. Today also inflictions occurring in retrospect can be considered under a application for an increase in pension in accordance with §§ 35, 206 Federal German Restitution Law [BEG] as subsequent occurring damage due to persecution by redetermining a pension. However, recognition of health treatment for such incurred infliction is no longer possible in principle.

This health treatment covers more especially reimbursement of costs for:

  1. the necessary medical treatment and the provision of pharmaceuticals and healing and help aids
  2. a nurse or accommodation in a nursing facility
  3. psychotherapeutical treatment
  4. taking a cure.

The costs will only be reimbursed upon application. The application form provided is to be used for this purpose. This has to be completely filled out and be sent with the necessary original receipts and documents either to the responsible agency of the Federal Republic of Germany abroad or to the Office for Personal Compensation – OPC - in Tel Aviv Israel or directly to the responsible compensation authorities. In the case of cures this is a special case in that this calls for previous approval of the compensation authorities. The application for taking a cure is to be made by using the official form and be directly addressed to the compensation authorities and to the Office for Personal Compensation from abroad – OPC in Tel Aviv, Israel.
